Lawyer: Nevada assemblyman released from hospital

LAS VEGAS (AP) -- The lawyer for embattled Nevada Assemblyman Steven Brooks says his client is out of the hospital.

But Mitchell Posin said Thursday he's had no contact with Brooks, a North Las Vegas Democrat who was arrested Jan. 19 on a felony charge involving an alleged threat against incoming Assembly Speaker Marilyn Kirkpatrick.

Brooks was taken for a psychiatric evaluation last Friday after officers responded to his grandmother's house on a report of a disturbance.

Elected to a second term in November, it's unknown whether Brooks will be in Carson City on Monday when the 2013 Legislature convenes. But he made appearance in the capital city last week to find a place to live, and told legislative staff he plans to take his seat.
