Patrick Cody McCormick was arrested in 1996 and convicted of killing 14-month-old Jacob Jones. Prosecutors argued McCormick had fatally beaten and shaken the child.
McCormick spent more than 16 years in prison, but the state's high court overturned his murder conviction in 2012. They stated that a penicillin allergy could not be ruled out as a cause of death.
The Elko Daily Free Press reports McCormick, who has been free on bond since February, has agreed to plead no contest to involuntary manslaughter. McCormick is expected to be sentenced to time served.
